LIABILITY WAIVER

By personally participating in or permitting my Student(s) to participate in activities at Chenal Elementary School organized by Gator Group PTO, I agree to the terms of this Liability Waiver. I understand that these activities may involve some element of personal risk for myself and/or my Student(s), and assume all such risks, including but not limited to the risks of serious bodily injury, paralysis, loss of life, and damage to personal property. In further consideration of our participation in the activities, I, for myself and my Student(s), hold Chenal Elementary School, Pulaski County Special School District, Gator Group PTO, and their respective staff, employees, members, officers, directors, principals, agents, representatives, board members, volunteers, and assigns (the “Hosts”), harmless and forever waive, release and discharge the Hosts of and from any liability, injury, loss, or damage sustained by me and/or my Student(s) as a result of our participation in the activities, whether such loss or damages result from products liability, strict liability, or the fault or negligence of the Hosts. I shall further indemnify and defend the Hosts from and against any claims, liability, loss, or damages, including attorneys’ fees, to other persons or property arising out of the participation of me or my Student(s) in the activities, whether such loss or damages result from products liability, strict liability, or the fault or negligence of the Hosts. I agree to comply with the stated and customary terms and conditions for participation in the activities and, if I observe any hazardous or dangerous conditions during such participation, I will remove myself and my Student(s) from participation and bring such conditions to the attention of the Hosts immediately. I give my permission for the Hosts to use, videotape, photograph, televise, or otherwise record my image and that of my Student(s) in connection with Gator Group PTO. I agree that I have read this Liability Waiver and fully understand all of its terms and conditions. I am 18 years of age or older.
